To commence arbitration, please submit a Notice of Arbitration along with the registration fee. Our case management team will assist you throughout the process.

Mediation offers a flexible, confidential, and consensual process where parties work with a neutral facilitator to resolve disputes without the cost and time of arbitration or litigation.

MEDIATION RULES


Flexible Process

Parties agree on procedure, timing, and mediator selection. Mediation can be conducted in person or virtually.

Confidentiality

All discussions are without prejudice and cannot be used in subsequent proceedings.

Enforceable Settlements

Reached agreements can be converted into consent awards or binding contracts.

MEDIATION COSTS


Mediation costs are shared equally unless agreed otherwise. Fees are based on the mediator's rate and duration.

  • Registration fee: €1,500
  • Mediator fees: €300 - €600 per hour
  • Administrative fee: €500 per day
  • Cancellation policy: 50% if within 7 days

To initiate mediation, both parties should sign a Mediation Agreement or submit a joint request.

The following model clauses are designed for inclusion in various aviation industry contracts. Parties are advised to tailor them to their specific needs and seek legal advice.

ARBITRATION CLAUSE

Recommended wording:
"Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by Aviation ADR in accordance with its Arbitration Rules. The Rules are deemed incorporated by reference.

[Optional provisions:]
– The arbitral tribunal shall consist of [one/three] arbitrator(s).
– The seat of arbitration shall be [city, country].
– The language of arbitration shall be [language].
– The governing law of the contract shall be [governing law]."

MEDIATION CLAUSE

Recommended wording:
"The parties may at any time, without prejudice to any other proceedings, agree to attempt to settle any dispute arising out of or in connection with this Agreement through mediation in accordance with the Mediation Rules of Aviation ADR. The mediation shall take place in [city, country] and the language shall be [language]."

MULTI-TIERED DISPUTE RESOLUTION CLAUSE

"Any dispute arising out of or in connection with this Agreement shall first be referred to mediation in accordance with the Mediation Rules of Aviation ADR. If the dispute is not settled within [60] days of the appointment of the mediator, or if either party refuses to mediate, the dispute shall be finally resolved by arbitration in accordance with the Arbitration Rules of Aviation ADR."

DRAFTING GUIDANCE

  • Ensure the clause is clearly visible and not buried in fine print.
  • Specify the number of arbitrators for clarity (default is one unless agreed).
  • Choose a seat in a New York Convention signatory state.
  • Consider including an expedited procedure for lower-value claims.
  • For multi-party contracts, address joinder and consolidation.
